La Renacida; una mirada crítica en tiempos de pandemia

El auténtico “tsunami” provocado por el COVID-19 va camino de provocar un cambio de paradigma en todos nosotros, equivalente a lo que podría haber sido el estallido de una Tercera Guerra Mundial.

Aunque la emergencia sanitaria que está provocando esta pandemia en muchos países, y en especial en España, es el aspecto prioritario en el que todos nos fijamos, no cabe duda de que superada ésta tendremos que detener nuestra mirada en los efectos económicos y sobre el mercado de trabajo que dicho maldito virus va a provocar.

Esto abre el camino para que nos fijemos en una de las palabras más utilizadas estos días, los ERTES, es decir aquellos procedimientos que han de realizar las empresas cuando como consecuencia de Fuerza mayor o por causas objetivas – económicas, técnicas, organizativas o de producción – tengan que suspender temporalmente la totalidad o parte de su actividad, con la consiguiente suspensión de los contratos o la reducción temporal de la jornada de trabajo de sus trabajadores.

Ríos de tinta han corrido ya sobre las incertidumbres y dudas interpretativas provocadas por la normativa express, capitulo a capitulo, que desde el Gobierno se ha publicado para atajar lo que sin duda va a ser una autentica sangría de nuestro ya maltrecho tejido empresarial, máxime teniendo en cuenta el peso del sector servicios y en especial del turismo, porque pese al rodillo mediático que nos insiste en la “temporalidad” de las medidas, nadie medianamente sensato puede pensar que esto es cuestión de unos pocos meses.

Es encomiable el intento de nuestros gobernantes de que el alcance y duración de las medidas de suspensión de los contratos o de reducción de jornada se adecuen y limiten a la situación coyuntural que se pretende superar, en este caso la derivada del COVID-19, pero una lectura sosegada del RD 8/2020 de 17 de marzo, y en especial de su disposición adicional sexta, ya nos alerta de que realmente son conscientes de que lo difícil viene después, porque cualquier empresa que se acoja a las medidas excepcionales recogidas en dicho RD viene obligada a  mantener el empleo durante los 6 meses siguientes a la fecha de reanudación de la actividad, en este caso del levantamiento del estado de alarma, lo que nos sitúa, como muy pronto, en una obligación de mantener el empleo hasta finales de octubre.

Pese a la algarabía producida, menos impacto le otorgo a la mal llamada prohibición de despido del RD 9/2020 y resto de sus medidas, ya que si nos atenemos a su Disposición Final tercera su vigencia queda reducida al estado de alarma y sus prorrogas. Si finalmente la interpretación es otra, y dicha restricción de extinguir contratos vía despidos objetivos se extiende más allá del estado de alarma, mi conclusión sería obviamente bien distinta y mucho mas negativa.

Pero volviendo a la obligación de mantenimiento de empleo posterior al estado de alarma que recoge el RD 8/2020, me sigo preguntando si alguien en su sano juicio es capaz de asegurar en estos momentos que las empresas van a poder mantener su nivel de empleo anterior a la pandemia como si nada hubiese ocurrido. Yo modestamente no lo veo, y quizá por eso la ambigüedad del RD da lugar a muchas interpretaciones, brillando por su ausencia cuáles serán las consecuencias en caso de que la empresa no cumpla dicho compromiso. Una vez más, esto puede quedar en un “brindis al sol” ya que justo cuando termine la emergencia sanitaria empezará la emergencia económica.

Pero el objetivo fundamental de este artículo no es reiterar lo que a modo de “Guía del consumidor” y con mayor o menor acierto podemos devorar estos días de confinamiento en RRSS especializadas, webs jurídicas e incluso en cualquier medio de prensa generalista sobre la tramitación, modus operandi y procedimiento de un ERTE, sino ir un poco más allá y rendirle un merecido homenaje a la tan denostada reforma laboral que en el año 2012 se aprobó en España.

Alguno se preguntará ¿…y que tiene que ver el COVID-19 y sus efectos en el mercado de trabajo con la Reforma laboral?…pues miren Vds. tiene mucho que ver, es más, gracias en parte a la NO derogación de esa reforma laboral y de sus medidas de flexibilidad interna, muchas empresas de este país van a poder dignamente salvar los muebles en el futuro y bien haría este Gobierno en utilizar la excusa del COVID-19 para no acentuar la futura crisis, porque si cuando superemos la emergencia sanitaria e intentemos volver a la normalidad, a alguien se le ocurre eliminar o restringir los mecanismos de flexibilidad interna que actualmente tenemos gracias a la Reforma laboral de 2012,  la “cultura de la muerte”, de la que hablaba el Profesor Juan Antonio Sagardoy para referirse a nuestro mercado laboral, estará de vuelta en nuestro país.

Si profundizamos un poco mas sobre las medidas adoptadas por el Ejecutivo para afrontar esta emergencia sanitaria en nuestras empresas y que, sobre todo, se generalizarán con posterioridad al Estado de alarma, observamos que la primera figura a la que se ha recurrido y con carácter preferente es la del Teletrabajo, estableciendo no una opción sino una obligación para que las empresas adopten las medidas oportunas que técnica y razonablemente posibiliten dicha alternativa.

¿Y saben Vds. cuando se reguló el actual modelo de teletrabajo en España? pues efectivamente, piensen mal y acertarán, con la Reforma Laboral 2012. Ya en la exposición de motivos del Real Decreto Ley 3/2012, de 10 de febrero, de medidas urgentes para la reforma del mercado laboral (apartado 3º) se habla del teletrabajo como un modo particular de organización del trabajo que favorece la flexibilidad de las empresas en la organización del trabajo y la vida personal y familiar. Con ello se modificó la ordenación tradicional del trabajo a domicilio, dando acogida a una nueva regulación del trabajo realizado a distancia basado en las TIC.

Otro conjunto de medidas alentadas por el Ejecutivo ante esta desesperada situación lo constituyen todas aquellas fórmulas que permitan flexibilizar horarios, fijar turnos escalonados, distribuir irregularmente la jornada e incluso pactar bolsas de horas. ¿Y saben Vds. de cuando data el actual modelo de tiempo de trabajo y sus posibilidades de flexibilidad? … pues efectivamente vuelven a acertar, porque precisamente gran parte de estas medidas se recogieron en el actual artículo 34 del ET tras la Reforma Laboral 2012 que posibilitó la distribución irregular unilateral por parte del empresario de hasta un 10% del total de la jornada anual.

Capítulo aparte merecen la modificación sustancial de condiciones de trabajo -en próximos meses imprescindible- o la prioridad aplicativa de los Convenios Colectivos de Empresa, herramientas ambas que también la Reforma Laboral 2012 facilitó para que  muchas PYMES de este país, frente a la alternativa del cierre, pudiesen dotarse de un modelo de bolsa de horas, de flexibilidad horaria, de adaptación salarial y de clasificación profesional ajustado a su realidad y que posibilitara el mantenimiento de un empleo digno y estable. Me pregunto pues, si tras la tempestad del COVID-19, alguien medianamente sensato va a seguir insistiendo en este país que hay que eliminar la prioridad aplicativa de estos Convenios de Empresa ante el escenario de recesión que todos los expertos descuentan para los próximos trimestres o dificultar el acceso a la modificación de condiciones.

Entenderán Vds. ahora el merecido título del presente artículo, porque si bien fue un espléndido Leonardo di Caprio quien dio vida al trampero Hugh Glass en “El Renacido” me da la sensación de que la auténtica “renacida” va a ser la “Reforma Laboral”, aunque nadie pudiera siquiera atisbar que el COVID-19 iba a ser su inesperado aliado para mantenerse en vigor.

Ante el mar de incertidumbre a nivel económico y laboral que se nos va a abrir en España cuando derrotemos al COVID-19 sirva esta modesta tribuna para pedir a quien corresponda la mínima responsabilidad para ir por el camino acertado, y éste no es otro que seguir ahondando en el modelo de flexibilidad de la Reforma Laboral todavía vigente…lo contrario implicará a buen seguro deslizarnos por un precipicio del que quizá no sea posible salir en décadas.
